Verua, were you there? Did you witness it? How would you know if he was assaulted or not? Where did you read this evidence you have? Did you self educate yourself on this topic? Did you read the police/jury reports? Why don't you read what was released and tell me what you think then. And if you can come back to me and say with 100% certainty what happened then you are a fool.

This isn't a direct quote but the ruling establishes that- the officers actions must be objectively reasonable based on the facts known to the officer at the time of the incident. Facts learned later, for instance that a gun is fake, cannot be taken into consideration when determining if the officer's actions were reasonable.

If you point a gun (including a fake one that looks very realistic) at a cop, you get dead. Period. Has nothing to do with skin color. Has to do with that cop wanting to go home to his family. It's always been that way and it always will be. Is it terrible and sad and tragic? Absolutely. Was it preventable? Absolutely. My heart goes out to that kids family. But it was stupid and unnecessary. -

Law enforcement is allowed to use one level of force above the level of resistance that a suspect is displaying. The kid was waving a toy gun, that is called aggravated active aggression, so the cops are legally allowed to respond with deadly force. The thing is, police are allowed to make judgement calls as to wether deadly force is really necessary. I think they made a bad judgement call when they shot a twelve year old. If you can't subdue a twelve year old without killing him, then maybe you should find a job that isn't as scary. Oh, and before anyone talks about not knowing what it's like, I can assure you that I do. I am academy trained and worked at a maximum security prison for over a year. I've been in plenty of situations where I've had all sorts of weapons drawn on me and I never had to use a bit of deadly force, it's too much paperwork.
