My wife was recently in a car accident. It trashed the side of her charger. We just got the car back last night and the bill was $4,000 which the 85 year old woman's insurance covered.
The 85 year old woman is completely at fault and has taken blame. Her insurance company (State Farm) is getting close to settling.
Aside from the damage to the car, my wife has physical therapy for 6 to 8 weeks or longer for her neck and back.

My question is, what is a reasonable amount to receive for this accident and what do we need to ask for. Our family has not been much help and the Internet can only do so much.
1. Vehicle depreciation
2. Pain and suffering
3. Time missed at work
4. Disturbance of our lifestyle?
5. ? -
In Australia that would be covered by the CTP (Compulsory Third Party).
As the laws are similar between countries, the old lady is likely liable for your wife's injuries also. Whether the insurance company picks up the tab would depend upon whether her policy included personal injury.

The general rule in Australia is you can claim an amount such that you are in the same position as though the accident never occurred. You can't claim such that you make a profit from the accident.

Mason DO NOT settle without an attorney!! You have to take into consideration long term effects of the Missus injury as well as anything that may develop as a direct or indirect result of this accident. This advice is coming from experience! Don't screw yourselves over. Legal advisors (as much as I don't like them) are imperative when trying to compensate for long term issues that may or may not arise.

Sorry to hear that. That can be a scary thing to go through. Glad she is alive though! As far as I can tell there is no formula for what is fail compensation. I think you would need to make claims based on the bills for therapy ... Pain prescriptions. Lost wages etc. if you think that there may be an issue in getting proper compensation that you deserve you may look into hiring a personal injury lawyer. You also may be able to get some direction from your insurance provider if they are good. Good luck and hope you get it resolved to your satisfaction.

She was crossing the intersection and the old lady made a right hand turn into her back passenger door and the fender. She had my kids in the car and was a block from daycare.

The chiropractor told her that without treatment, it could develop into arthritis down the road. I'm not a doctor or a chiropractor so I am not sure if this is a possibility or not.

Attorneys are Blood sucking scum bag, puss infested boils on the ass of society, money grubbing, leaches.
That being said, you absolutely need proper representation in a situation like this. And who better than a individual who is motivated by the sole fact that he will be compensated with 1/3 of as much money as he can squeeze out of the other side.
DO NOT even contemplate trying to settle yourself. -

You need a good personal injury lawyer. I hate saying that someone should call those sleezeballs, but they do have a place and this is it.

Mason - get a lawyer bro. The 15% or whatever they charge will still net you tons more than if you attempted to settle on your own. Remember, it's the insurance company you're up against, not the old lady - her rates already went up so she's out of the picture now. I know from personal experience how unethical and cutthroat insurance companies are, so make sure you go in there properly represented. Hire an atty.

Get an attorney. The Insurance companies will always try to cheat you out of money. This is coming from personal experience, as i am someone who needed to have back surgery after an accident... I even had to change my attorney twice because I felt as if the first didn't care but I won my case and I'm doing much better now. Don't go at it alone.

Forget vehicle depreciation, that's too hard to quantify, they will say it's "fixed" and who knows what that car will be worth in X years VS that exact car sans accident.
Lifestyle is also shaky, document expenses like driving back and forth to various places (fuel etc). Document time, but it is tough to quantify that as well, you don't get paid 10 bucks an hour to grocery shop, your time spent (that was not during "work" hours) is unlikely to be monetarily significant. Any vacation or sick time used SHOULD be compensated as you would still have it were it not for the crash.
Lost wages are obvious, as are medical bills.

You have a time frame (maybe 2 years - find out) to sue.
Retain an attorney now, as far as medical bills, if a dr knows you have representation, he will likely allow you defer payment, however the doc will likely require you to put into the settlement agreement that he gets paid directly from the attorney.
So you will have your nearly 2 years actual expenses documented, your medical bills, either paid out of pocket or deferred to the settlement, and a reasonable prognosis for future treatments needed.
Shoot for that amount times 3. 1/3 for the scum sucking bottom feeder, 1/3 to cover all expenses, the extra 1/3 for future expenses, pain and suffering, intangibles. You may end up accepting a settlement for slightly less, maybe 250% of expenses instead of the 300% in the above scenario.

Glad you are ok, but don't kill the woman with expenses! Insurance exists to replace what was broken or lost, not make a profit.😁
