You need a lawyer to sort this. Depreciation on your vehicle will be nil but the rest is up to medical records and substantiation.
The law aspect won't cost you anything and they will claim their costs from the third party insurers. -
More simply put.. Get an attorney. Do NOT accept a settlement. File a lawsuit in 23 months (if I am right about the 2 year time frame). They will almost certainly settle at that time, you won't actually go to court. They'd lose and the expense to them is more than the extra you'll be asking for in additional compensation.

This is uncharted territory for me. I am learning very quickly as to what to expect.
As for the wreck, it could have been worse so we are lucky for that. That Charger is like a tank.

You have to take into consideration long term effects of the Missus injury as well as anything that may develop as a direct or indirect result of this accident. This advice is coming from experience! Don't screw yourselves over. Legal advisors (as much as I don't like them) are imperative when trying to compensate for long term issues that may or may not arise.

Today was a rough day. It seems like she is getting pinched nerves in her neck which is causing headaches. She was not able to get out of bed until noon.
Apparently the chiropractor was able to help her release it but to be honest, I don't know if he is doing more damage than good. I'm kind of a natural skeptic.

Find out her policy limit...figure 1/3 attorney, 1/3medical, 1/3 for you and kids(they get some too(college fund starter)). Get the attorney

I live in the town of State Farm HQ and have friends working in claims there. Trust me, you want a good attorney, otherwise they will settle what THEY think is fair. And don't go by yellow pages for your atty; get a strong referral. Good luck to u and wife.

For me, the chiropractor did more harm than good. I quit going and hit the gym to strengthen the back to hold the spine in place.

My wife was in a similar accident as this sounds...she recieved around $7000. She went through physical therapy and all as well.

I work with insurance in Sweden. There are big differences when it comes to laws between our countries. Here we have laws that forces you to insure the car, like Hyena stated about CTP in Australia. If this accident occured here you would have gotten pay for damages to the car, pay for bodily damages and some for pain and suffering. I do not personally handle claims but i dont think you get paid for loss of income. There are other insurances here that kick in in those cases.
