Talk to Officer Ahsley...
Anyways from what I had heard he can still get in trouble, and sued.
Now a days you can sue people for anything. -

Hey! He can be sued, but the question is: if he is sued, will he win?
From the story you told me, the suing party will definitely have a weak case. Try settling it out of court because it might cost more. As long as it was self-defense, it's okay.
-
He can be sued. But he can also sue. Self-defense is a defense that can be used in court.
-
I don't think he can be sued but I believe charges can be pressed which won't happen becuase he can press them right back( I believe I'm correct becuase I already have two assult charges I'm on probation for...)
-
Go back and hit him again. Cap him

Criminal and civil laws are different in each state. As others have already said, you can sue for everything these days. Doesn't mean theyll win. Just a few weeks ago a DUI manslaughter suspect sued the family of the victim. I could sue you for making this thread, claiming all kinds of BS. Massive waste of money and resiurces so don't expect your friend to get sued over a school fight unless serious bodily harm occurred.
-
You bet he could sue you. It would be a civil tort, and he oils prove you caused harm so a judge may hear it.
But it was in self defense (assuming you're giving us all the details), so the chances of him winning are slim to none.
At the same time you could press criminal charges for assault, not that I'm suggesting you do that.

*can prove, thanks auto correct.

He can be sued but since it was self defense the other person won't win
-
Nj dosnt have self defense :(

If its just a school fight i doubt they would sue, ive been in a few but no sueage (<-- lol) so yeah

Any time I've done any type of
case work with fights, I do them as mutual assault. Both parties are liable. -
Yup this is all true. A lady sued McDonald's for having burnt herself because she drank coffee.
This is why it says Caution: Hot on the cups now. 😂

Gotta love those good old fist fights
🏫😠😠👊👊😲😲🔨🔨 -
No way it's all good if the first guy got a good whack he was defending himself😼
-
That's kinda like the thief suing the homeowner because he hurt himself trying to steal from the house. I don't think the origional attacker will win, because the other guy could plead self defense. He didn't break anything/kill the guy, so he should be safe. Good luck! 🔨🎉

Look up that case. You'll be surprised at the truth. It's Liebeck v McDonald's. Also, only the state can bring criminal charges, but either party can sue civilly for assault and battery. And self-defense can be used as a defense anywhere, that doesn't mean it will work.Yup this is all true. A lady sued McDonald's for having burnt herself because she drank coffee.

If nobody seen anything then don't worry about it, worste thing that could happen if the guy could goto the police and have your friend charged, it's upto the court to decide if self defense or notSo my friend at school was hit in te face today and he thit them back in the face and the other person started bleeding. By the federal statues , if you are attacked you do not have a duty to retreat . Legally you can stand your ground and protect yourself, however if the other individual stops the attack you cannot continue . If you have anymore question I have all the info available. And can answer any question you may have. Iam a instructor in this field , I can direct you to the proper places to gather info. You can look up use of force and castle laws

I don't even remember the names of the people involved. It was just one of those news stories where I thought "really?". It's sad when a victim or their family of a negligent act can be sued by the perpetrator.PANTERA. wrote:

Liebeck v McDonalds is not the case it was made out to be in the media. While I am disgusted at the sheer number of people who look for "free money" via bullshit lawsuits, the MacDonalds case was a valid lawsuit. Google it or watch the documentary.
