Question about Visas (America)
Forums › General Discussion › Question about Visas (America)-
I'm planning on going out to America later this year, hopefully for good.
Just wondering, if I go on a tourist visa, but find work while I'm out there can I upgrade my visa to a temp work visa?
What's the best way to move there permanently without getting married?
Any help would be fantastic.

I could go on a family visa if I was engaged, but you have to marry within 90 days of entering the states.YOU wrote:

Yes, apply for a change of status. Only reason I know is because I went through the imigration process with my wife. PM me if you have any questions.I'm planning on going out to America later this year, hopefully for good.

There are many loop holes around that bud, hire a expert to find them or attempt to do so yourselfHated wrote:

Before you come to America you should tweet that you want to dig up Marilyn monroe's grave.
That tends to expedite the visa application process.

you can get a company to sponsor you if you have a skill that a US worker doesn't - such as : IT , programming, foreign car mechanics, design or anything specialised. The company has to justify hiring a non US citizen by saying that they can't find anyone to do the job here.... that said, it's easier to get married - I did.

Single white male here. 😉💪

I'm an unskilled worker, so not going to get anything like that, but if I got a "normal" job would I still be able to stay?
The major reason I'm heading out is to be/stay with a girl. We've joked about if I can't find a way to stay then she'd marry me, but wouldn't that also cause problems? Would it guarentee that I could stay? (I'd marry her one day, but I don't think that either of us are ready for that yet.)

Could always enter the green card lottery. It's a long shot but worth a shot.

If you plan on moving to America then you definately want to work with an immigration lawyer. It is my understanding from my friends overseas and coworkers with H1Bs the process is quite intense and each visa is totally seperate. Overstaying a visa is grounds enough to deny a follow on visa so while you could apply for a work one here (and hope your employer would sponsor you, and you get lucky in the visa lottery) if it's not granted before your tourist one expires you'd have to leave then come back when it's valid. I've never heard of a work visa being granted in 90 days.
The marriage route has gotten a lot more difficult than it has been in the past. You can always risk it though.
The Canada route might easiest.

Even a marriage visa can be denied if USCIS thinks the marriage is fake. Definitely lawer up. My wife's CR1 visa took nearly a year and a half even with a lawer. Also keep in mind that the filling fees are really expensive and non-refundable.

Good luck finding a job...

I have read that they made an extra 10,000 visas available for Australians, any other nationalities?

Yeah, an unskilled worker is very easy to come by here. There are people with college degrees taking the "normal" jobs, and with all the military coming back they have priority over even a skilled worker in my area.

I guess it depends on how bad you want it (as everything else in life) , you might as well marry her, it may not work out in the long run, but how would that be different than any other day?

Sorry if this is harsh, but do it right or stay out.
You seem like a cool guy and we would welcome you to stay, just start off on the right foot.

Yes, however my wife did all of her imigration stuff while still in Holland, while I was in the states. I was never interviewed. She entered on conditional resident visa (CR). I'm assuming you did an adjustment of status?Mr_White wrote:

Are you poor, hungry, or opressed? We have a thing for that...

yes we were both in the US. Although I was about 7 years past my visa expiration, it all went away when I got married -

We talked last night, and decided that I'd go over for a little bit (few weeks) then head back to Engalnd and return a couple of months later and get married. I'd wanted that for a while, but wasn't sure about what she wanted. Anyway, that's our plan of action and I just hope that everything works out. Better get saving.
