Its your property so you can jailbreak it is legal
Someone took the time to create, market, and copyrite those pricy apps and music so that part is illegal.

The best jailbreak is Greenpoison it really screwed up my iPod though. I had reset my iPod to make it make it work again

If you do jailbreak it it will void your warranty with apple. Although if you restore it they won't be able to tell

But doesn't apple track the restores? When I restore mine it says "Verifying restor with apple" I'm sure they can tell if its jail broken.
