Sorry to hear about your knee. That sucks. And even worseโฆ The denial by the insurance company. (I surely hope your appeal ends favorably.)
And I know from many of your previous posts that you seem to lean libertarian and that suing may seem frivolous. But hellโฆ Sometimes it's the only recourse, especially if they keep giving you the runaround merely because of greed. It's obvious you did the noble and correct thing. But if they can get away with it, they will.
I guarantee thoughโฆ A good lawyer willing to work on contingent fee will get that insurance co. to talk to you as a human being and not merely a statistic that will go away.
That's what legitimate lawsuits are all about. Holding companies and individuals accountable to what is right.
No need to suffer because they blatantly reneged on their services.

I'll just have to see how it pans out. I have been to the doctor 11 times, taken 4 x-rays, wore a knee brace for a month, have taken steroids and inflamatories, 7 visits to physical therapy, an MRI, 2 visits to an orthopedic surgeon, and a cortizone(sp) shot to the knee cap. Nothing has helped and if anything, it has only gotten worse. I have not had a moment without pain in my knee since November 9.
The kid that did this has autism and is also diagnosed with being bi-polar. He is extremely high functioning. Several of us have had to file paperwork due to getting hurt by him either by thrown chairs or whatever he can swing. He is in first grade and his teacher has already had 2 miscarriages while having to teach him.

I'm just at the point now that I need to get my knee fixed. Sucks having to deal with so much red tape. Worker's comp is telling me that I need surgery but because they believe that my issues stem from a previous injury (using the MRI info that was done 3 months after my unjury took place), they are not going to pay for it. Despite the fact that I have never had knee trouble nor any medical documentation of hurting it, they are a struggle to deal with.

So basically... worker's comp is looking at a smashed up knee and somehow... just somehowโฆ detecting a former injury that has nothing to do with this event? (And also declaring it as the main culprit in your problem.)
That's such B.S. I think you should get them to prove it beyond a shadow of a doubt. After all, the burden of proof is now upon them. I'm sure there will be plenty of holes in their lame defense. (Most likely predicated upon... scar tissue... Duh.) If this case wasn't so sad, I'd say their position is nearly laughable. A good lawyer will have a field day with this and have the jury laughing in stitches.
And even if there were "former injuries"... the fact that your knee was smashed in this event (on record) has nothing to do with that "former non-injury" regardless.
Stuff like this is maddening.

Addendum: In shortโฆ The reason you can no longer work is because of this event. You were functioning and working fine just before that dreadful day... even if you did have an "injury."

My adjuster said, "You absolutely need surgery on your knee, however, from the looks of the MRI, it appears that you have a pre-existing injury to your knee that we are not responsible for."
They are claiming that the injury was already there and the day I restrained the student ended up reaggravating an old injury.
My frustration is that I have never injured my knee and the MRI was taken 3 months after I injured it. Which, I am no doctor, in my mind 3 months after an injury, it would appear slightly different than it would have if we did it after the incident.
My doctor had believed that I had torn my miniscus(sp) and my original MRI was denied until I had completed physical therapy which in fact made me worse. The MRI shows that I have a cyst in my knee (sort of like a blister). So, physical therapy acted much like if you had a blister in your shoe and you rubbed it for over an hour several different times. The therapy nearly crippled me.

Ladies and gentlemen of the jury: We've asked Mr. Mason if he was working prior to November 2015. He replied- yes. He was happily working and very active. None of his peers ever witnessed him limping or using a cane which would indicate any kind of former injury.
After that dreadful day. He could no longer work. I leave it to your common sense to conclude that... there is a connection.
The proof has been set before you regarding the injuries he has sustained via witnesses and medical records.
So I ask you โ which is more plausible โ that he can no longer work because of some "former" injury of which no definitive proof has been offered by the defense other then vague images from an MRI 3 months after the fact?
Or his situation the result of this well documented event?
Does it not also seem reasonable to you that the defense is negligent in their duties and in the interest of saving money... Pushing Mr. Mason side?
I think we all know the honest truth here. I rest my case your honor.
