Not cool, man. I am sure you didn't have a clue what you did was this serious and I'm sure you regret it now. Like everyone else said I'd apologize to the school and her parents and make sure they understand you are sincere and really do regret what you did

Good point. I was saying that her, or her family could easily sue you or your parents (depending on age) for libel. That depends on laws where you live but Im pretty sure there isn't much variation on that.Screw libel. You are a felon.

If they really wanted to, you could get some time in Juvi.

Obviously, you live in the States where this is even an issue. The terms and conditions of social programs and networking - is use at your own risk. It's similar to banking - if I shout out my PIN # while I'm doing a visa transaction, that's a security breach that I incurred. However, it's still illegal for the criminal behind me to charge out my card. This can be chalked up as a personal dispute, and should not involve your educational institution - quite frankly, you could potentially sue them for withholding owed/paid services. I'm actually suprised any authority stepped in for this - what are you at, Bible College? Apologize to daddies princess, and enjoyment day off to mob up. If I were you, I'd put a lot of heat on the school for treating you inappropriately.

Definitely be glad that the school is handling it. If the parents went to the police, they (they may still be able to) would have an easy case.
-
turfwarroir-my principle said this was a big deal and i was shocked. im apologizing to the family tomorrow.
thrilla and bugsy-you both sound like you have good points. im in a way glad the school got imto this now that i know police would be worse. but still, its out of school stuff. you guys are really informative, ill never do this again 🙍 -

I'm pretty sure he's not college age yet - either junior high or high school. You can ask why they got involved, but like I said, you took information you learned at school (her password in computer class) and then used it against her. The school might even get in trouble for not doing anything. Hopefully the girl has learned not to share her password & not to use the same one for everything - duh!

Identity theft of this nature is *the single most* prolific problem in terms of cybercrime. That it was facebook mitigates nothing. If the same offense were committed this girls bank account, we would all be having a different conversation. You need to learn that this *is* serious, and is not ethical or excusable in any context. I honestly hope they report this to Facebook and have your account deleted in its entirety.

I am no lawyer but I would think there is a difference in the eyes of the Law between this hacking and hacking a bank account.

No no. He did not "hack" into her account. A "hack" is when u modify a website or program. He did no such thing.

What he did WAS totally wrong but it was not hacking. More like unauthorized access.

Anything put on facebook can never be deleted from facebook. It is in their system forever. Even if you delete your account they still have a record of every thing you have ever put on it. My buddy writes music and always sends himself a copy of the music in the mail so that it is dated and then never opens the letter/package containing the cd to prove he was the originator of his music before posting it to facebook. Kinda a cheap way of copywriting his stuff. But yes the school should become involved because the "crime" was originated at school. That is where he premeditated his actions.

an also don't appoligize to her or her parents tell em she had it comin by saying her password outloud u don't owe them anythin don't sweat it bro I'd jus tell everyone to get fucked including ur principal ur in 10th grade ppl do that all the time it's not a big deal

First, just because someone leaves their house unlocked doesn't make it ethically or legally right to walk in and make yourself at home without their permission.
Second, under their TOS, as mentioned, he would be banned from Facebook.
Third, unauthorized access to a computer system is illegal and does not require anyone to "press charges". The government could prosecute if they chose to. That also goes for any new "cyber bullying" laws that have been popping up lately.
Last, the libel is a civil component, not criminal. That would be a civil lawsuit that would happen independent of the criminal prosecution. The girl would have to sue. However, the libel case would be proven in the criminal case to establish "damages", making the civil suit much easier.
He's very lucky the school is administering punishment and not the district attorney or the girl's family.
I'm always amazed what people think is "no big deal."

Jeez it's only facebook stop shittin yourself. People face rape each other all the time. They would laugh in court

Yes, cyber crime and identity theft is a real issue - but editing a FB status line is not a punishable offense anywhere. If it's detention Blindluck gets - so be it. Social engineering to gather information is not illegal, and sadly, neither is stupidity. Zombie is correct though, using that new found intel against someone - IS illegal. The caveat in this case, however, is that there was no personal gain for the offender. It's the equivalent of scrawling the same words onto her locker - the worst you'd get is a day off and be forced create apology. Make your fogiveness interesting - high lighting the needs of personal internet security.
-
It seems to me they should have classes or 1 day special speakers in schools to teach these kids about personal Internet security and identity theft.
Now a days a lot of colleges and companies check these sources when investigating new candidates for whatever position. Stuff like this CAN affect you in ways you don't think of when young.
And it's NOT a joke. -
I'm bored of this topic now.... Can we move on?
