It has been brought to my attention that there are a quite a few players who 1) use multiple devices on their accts and 2) these people have multiple users to manage their accts when they cant. My question to u is , is this fair play. Please leave your comments on how you feel about this. Also isn't that against ToS ?

to each their own. if they are using it to their "advantage", those players will be weeded out

I have a little brother who I tax. His account is on his IPad. I have never played on it. Is this muling?

There is nothing wrong. Its only when people start muling (using those multiple accounts to give yourself an advantage) such as taking turf from it, or attacking a player with all your accounts.
