Accident at work involving me and another forklift driver. I was driving and lifting something with my forklift when all of a sudden I was hit from the side of another forklift driver? Any suggestions. Pm me if you have and insight as to what I should do. I filled out accident and injury report doctors tomorrow morning. Please and thankyou

You were hit from the side by another forklift driver? Is this correct? Who do you feel was in the wrong? I know a bit about negligence from a UK/Irish perspective but not sure how it works in the States.

It is a little early for a lawyer. It is a work comp issue. Unless the company did grossly negligent things, then it is considered a risk of you job. I hope that you heal quickly without difficulty. Work comp can be a pain sometimes depending on the state in which you live.

You both will be at fault. Did you do your worksite inspection in the morning? They will look at that.

Consult a workers comp attorney immediately. There are things you need to to protect yourself and your livelihood. If you weren't determined to be negligent and have injuries, workers comp may deny your claim. Most workers comp attorneys will consult for free.

You can either sue the company and driver or collect worker's comp. You can't do both, so choose wisely.
Also, worker's comp does not care who is at fault.

Talk to your doc, be honest about your injuries, get a free consult with a lawyer and take it from there. If there's a case to be answered then it should be. Just be prepared to answer a shitload of questions.
Just going off the info you've given, it comes across like more of a 'cha-ching' moment. Forgive me if I'm wrong on that, lol. No offence intended. 😉👍

Always get your free consult from attorney. The company would be irresponsible if they weren't looking out for the best interest of the company also. In that regard, they are torn between you and the whole...protect yourself, they might not...
