can it capture one near it or does it have to be touching?

If i'm understanding you correctly, no they don't have to be touching. Just with in a certain distance and influence.

Right. You have to take his health down so low before capture.

I believe the area you can capture someone is the same as the diameter of a 84infulance turf (not the circle from where you can place turf from an 84, but the 84 itself). Yes you have to be able to win the last fight to capture a turf.
