Does the resistance penalty go away over time? I'm in a fight with someone that used to farm me and I'm to the point that I encounter a penalty.

Resistance kicks in when 30% of your total turf comes from another player. Those turfs will pay resistance. You need to either:

A: tear some of those turf down, or
B: build more of your own turf, or
C Cap some turf from someone else.

Options B and C will increase you total turf count, and provididng you don't cap any more off the "resisitance" turfs, they will shrink as a %age of your total turf and resistance will shrink and go away as well.

Provided they fall under 30% of your total turf.
