I use the experience ratio on my profile page to see how many points are needed to get to next level. I notice that some mobsters have a ratio > 1 (ex: 12,333/11,340). How does that happen?

you also get exp when you are beiing attacked. but you only level up when you are doing an action wich let you gain exp, like attacking or doing missions. the mobster in your example didnt do any missions yet or attacked anybody yet. the reason might be he is inactive or he doesnt care or he tries to remain under a certain level.
