I think that if someone is either 10 levels over another player or beats his defence with over 10000 attack,he can attack but not gain any money,exp or be able to cap his turfs

Such limits don't work well in a territorial game. There is a limited ammount of space after all. One of the fun aspects of this game is that no one is safe. Once you realize that the game will be much better.
