Shouldn't you have to surpass him to take it? Seems if he had it first, he would keep it in a tie.

If there is a tie in influence for the Capo title, the person who has never held the title before will "break the tie" and get Capo status. If both players have held the capo status at least once before, then the Capo will remain with whoever held the title before the tie occurred, and in order for it to change hands the influence tie must be broken.
